Terms of Service

These Terms of Service govern your use of Nezaton and all products and services provided through the platform. By creating an account or using Nezaton, you agree to these terms. Please read them carefully.
If you do not agree to these terms, please do not use Nezaton.
1. About Nezaton
Nezaton is an AI chatbot platform that helps small businesses automate customer conversations on their website, Instagram, WhatsApp, and email. Nezaton provides AI-powered products that businesses deploy to interact with their own customers.
When you purchase and deploy a Nezaton product, you become the business deploying the AI to your customers. Nezaton is the platform provider. This means:
Nezaton is responsible for providing you — the business owner — with a working AI chatbot platform.
You — the business owner — are responsible for how you configure the AI, what information you provide to it, and how your customers interact with it.
Your customers interact with your AI assistant, not directly with Nezaton.
2. Eligibility
To use Nezaton, you must:
Be at least 18 years of age
Be capable of entering into a legally binding agreement
Not be prohibited from using the service under the laws of your country or region
Provide accurate and complete information when creating your account
Nezaton is intended for business use. By creating an account, you represent that you are using the platform for legitimate business purposes.
3. Your Account
Account security
You are responsible for keeping your login credentials secure. Do not share your password with others. If you believe your account has been compromised, change your password immediately and contact us.
One account per person or business
Each individual or business should maintain one Nezaton account. Creating multiple accounts to circumvent limits, trials, or policies is not permitted.
Accurate information
You must provide accurate information when creating your account and keep it up to date. Providing false information may result in account suspension.
Account responsibility
You are responsible for all activity that occurs under your account — including actions taken by team members you invite.
4. Payments and Billing
Setup payment
Each Nezaton product requires a one-time setup payment to activate. This fee is charged once and is non-refundable. Your product is activated immediately after successful payment.
Monthly subscription
After activation, your product is billed monthly on the same calendar date. The subscription keeps your AI chatbot active. You can cancel at any time from your Billing dashboard.
Failed payments
If a monthly payment fails, your product enters a 3-day grace period. If payment is not made within 3 days, your product is paused. It can be reactivated by paying the outstanding amount at any time.
Pricing changes
Nezaton reserves the right to change pricing. If we change the price of your active subscription, we will notify you at least 30 days in advance by email. You may cancel before the new pricing takes effect.
Taxes
Displayed prices may not include applicable taxes such as GST. Any taxes required by law will be added at checkout.
5. Acceptable Use
You may use Nezaton to:
Configure and deploy AI chatbots for your legitimate business
Automate customer conversations on supported platforms
Capture leads and manage customer relationships
Access the API and webhooks for integration with your systems
You may not use Nezaton to:
Deceive, mislead, or defraud customers using your AI chatbot
Send spam, unsolicited messages, or conduct phishing through any connected channel
Collect sensitive personal data such as passwords, bank account numbers, or government ID numbers through the chatbot
Violate the terms of service of any connected platform such as Meta, WhatsApp, or Google
Resell, sublicense, or white-label the Nezaton platform without a written agreement with us
Reverse-engineer, copy, or attempt to extract the source code of Nezaton
Conduct automated attacks, scraping, or excessive API requests that disrupt the service
Use Nezaton for any illegal purpose or to facilitate illegal activity
6. AI and Chatbot Limitations
Nezaton uses AI language models (currently Groq / LLaMA) to generate chatbot responses. You acknowledge and accept that:
AI can make mistakes
AI-generated responses may occasionally be inaccurate, incomplete, or inappropriate. Nezaton does not guarantee that every AI response will be correct. You are responsible for reviewing and configuring your chatbot to minimize inaccurate responses.
You are responsible for your AI responses
When your AI chatbot responds to your customers, those responses are being sent on behalf of your business. You are responsible for the content your AI sends. Configure your business profile, FAQs, and instructions carefully.
Human handoff is your responsibility to monitor
When conversations are escalated to your human team, it is your responsibility to respond in a timely manner. Nezaton is not responsible for delays in your team's response to escalated conversations.
AI availability
We aim to maintain high uptime for the AI service but cannot guarantee 100% availability. Planned maintenance and unexpected outages may occur. We will communicate downtime in advance where possible.
7. Your Customers' Data
When your customers interact with your Nezaton chatbot, their messages and contact details are stored in your Nezaton dashboard.
You are the data controller
For the purpose of data protection laws, you are the controller of your customers' data. Nezaton acts as a data processor on your behalf. You are responsible for having a lawful basis to collect and use your customers' data.
Inform your customers
If you deploy a Nezaton chatbot on your website or Instagram, you should inform your customers that their conversations may be processed by an AI system and that their contact details may be stored.
Data deletion
If one of your customers requests that you delete their data, you can delete individual conversations and leads from your Nezaton dashboard.
Do not collect sensitive data
Do not configure your chatbot to ask customers for sensitive data such as passwords, bank account details, Aadhaar numbers, or payment card information.
8. Intellectual Property
Nezaton owns the platform
The Nezaton name, logo, platform, codebase, and all associated intellectual property belong to Nezaton. You may not copy, reproduce, or create derivative works from any part of the Nezaton platform.
You own your business data
The business information you add to Nezaton — your services, FAQs, customer data, conversations — belongs to you. You can export and delete your data at any time. Nezaton does not claim ownership over your business data.
Feedback
If you provide feedback or suggestions about Nezaton, we may use this to improve the service without any obligation to compensate you.
9. Termination
You can close your account anytime
You may delete your account at any time from Account Settings. This will permanently delete your account and all associated data within 30 days.
We may suspend or terminate accounts
Nezaton reserves the right to suspend or terminate your account if you violate these Terms of Service, engage in abusive or fraudulent behavior, or use the platform in a way that could harm other users or our systems. We will notify you by email before taking action except in cases of serious abuse.
Effect of termination
Upon termination, your access to the platform and all products will be removed. Data will be retained for 30 days after termination to allow for export requests, then permanently deleted. No refunds are issued upon termination due to policy violations.
10. Limitation of Liability
Nezaton is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:
Nezaton does not guarantee that the service will be error-free, uninterrupted, or perfectly accurate at all times.
Nezaton is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform — including lost revenue, lost customers, or business disruption.
Nezaton's total liability to you for any claim arising from use of the platform shall not exceed the total amount you paid to Nezaton in the three months preceding the claim.
You are responsible for ensuring that your use of Nezaton complies with all laws and regulations applicable to your business.
11. Third-Party Platforms
Nezaton integrates with third-party platforms including Meta (Instagram, WhatsApp), Google, and Razorpay. Your use of these integrations is also governed by those platforms' own terms of service.
Nezaton is not responsible for changes to third-party platforms, APIs, or their policies that may affect the functionality of your Nezaton products.
We will communicate known platform changes that affect Nezaton products as soon as reasonably possible.
12. Changes to These Terms
We may update these Terms of Service from time to time. If we make significant changes, we will notify you by email at least 14 days before the changes take effect.
Continued use of Nezaton after the effective date of updated terms means you accept the new terms. If you do not agree, you may close your account before the changes take effect.
13. Governing Law
These Terms of Service are governed by the laws of India. Any disputes arising from these terms or your use of Nezaton shall be subject to the exclusive jurisdiction of the courts of India.
For international users, by using Nezaton you agree that any disputes will be handled under Indian law.
